Privacy & Personal Data Protection Policy and User Terms and Conditions  

This statement relates to the use of the website/portal identified as www.peoplepsyence.com and www.oz.zone operated by People Psyence Pte Ltd. (“PP”). The reference to “PP” in this statement shall apply wherever applicable to Oz.zone

Please read the following carefully to understand our policies, views and practices regarding your personal data

This policy, together with any other documents referred to in it, sets out the basis on which any personal data of the user, customer, client, subscriber or his/her/their respective agent(s), servant(s) or employee(s) (severally referred to as “the User”) provide to us by the person entering, typing or keying-in such data into the data entry sheet or virtual screen, website, platform, questionnaire, survey of any virtual file or storage system of PP and of PP’s associates who are involved in the services offered by PP. (The names of the associates of PP are available on our website. The policies and terms of use of PP’s associates are available on their respective websites. Changes and updates are available upon request).

You (the User) are deemed to have accepted and consented to the practices and terms described in this statement by using or participating in PP’s services in any manner whatsoever. You are further deemed to have accepted the policies and terms of use of PP’s associates, wherever applicable.

A. Services provided by PP

PP is a Human Capital Solutions Provider which includes Psychometric Testing Services . As part of our services, we utilize psychometric assessments (scientific methods and quantitative measures) to better understand the competency and psychological variables of a person such as personality, aptitude, emotional intelligence, values, skills, competency, mental toughness. We further offer Human Resource consulting services which include techniques in Competency Modelling, Succession Planning, Talent Acquisition, Talent Management & High Potential Identification, Talent Learning & Development, Design Thinking & Innovation, Co-Creation, Workshop Facilitation, Gamification and various other HR models.

PP adopts an empirical, data-driven psychological approach to understanding people with the objective to diagnose and identify people needs, prescribe and propose the appropriate solution and conduct the intervention, execute and implement solutions as required by the client.

We run diagnostics to ascertain the underlying causes of an issue using a range of assessments. When the root cause of people issues or problems has been determined, a prescription of elements that need to be changed or modified may be advised. This includes the recommendation of practical HR interventions to produce the desired behaviours and cultures. To complete the cycle, appropriate interventions may be implemented to ensure the desired changes take place. We also offer post-intervention assessments to evaluate an individual’s progress.

B. PP’s relationship to the Client and to the User

PP provides their services to the entity (referred to as “the client”) that engages and accepts PP’s services upon terms agreed between PP and the client. The individual who participates in PP’s website, platform, questionnaire, survey or services is referred to as “the User”.

PP only contracts with and is accountable to the client, who may or may not be a User as herein defined. PP is not contracting with nor is accountable to every User who uses the virtual platform of PP and PP’s associates. PP is not required or obliged to offer or furnish to each User, PP’s reports, evaluation, assessment, diagnosis, prescription, intervention or recommendation whatsoever.

By participating in the services offered by PP and PP’s associates, the User irrevocably agrees and consents that PP and PP’s associates are authorized to furnish to the client all reports, evaluation, assessment, diagnosis, prescription, intervention or recommendation of the User who is engaged by that client.

In most occasions, the User is an employee or target personnel of the client. The User is deemed to be voluntarily participating in the services provided by PP for the client. The User participates in the services of PP at the User’s own volition. It is recommended that the User communicates with the client with regard to any clarification, doubt, caution or hesitation to participate in the services provided by PP.

The client is deemed to have given and/or obtained the consent of the User to participate in the services of PP. The client is also deemed to have procured all relevant consent(s), permit(s) and/or licence(s) that may be required by any authority to enable the client and/or the User to provide or share data and participate in the services of PP.  PP shall not be held liable or responsible for the non-procurement of any such consent(s), permit(s) or licence(s).

PP or PP’s associates do not furnish any report or personal information to any party other than the client.  The assessment reports and services provided by PP or PP’s associates to the client may be used by the client for purposes which may include the selection and development of individuals in an employment or human resources context. Clients are entitled to use the reports that we provide to them as part of our services for their own purposes. However, such clients are obliged to use such personal information in accordance with applicable data protection laws.

C. Personal data / information

The aim of PP is for the User to feel safe with our use of the User’s personal data.

We respect the user’s right to privacy, and we are committed to complying with applicable law and data protection rules and to safeguard the rights of the User. This privacy policy applies to the processing of personal data by PP and PP’s associates in relation to the User whose personal information we obtain in connection with our services. It describes how PP as a data processor collects, uses, discloses, stores and otherwise processes the personal data of the User. This Privacy Notice also describes the User’s rights in relation to the personal data.

The use of the term “personal data” or “personal information” includes other similar terms under applicable privacy laws. In general, personal information includes any information that identifies, relates to, describes or is reasonably capable of being associated, linked or linkable with a particular individual. This includes the information the User provides us via our website/portal and/or in connection with our services, such as when the User registers on our website/portal  or complete an assessment by our associates

We may collect personal information directly from the User, automatically related to the use of our website/portal  and other services and from third parties, as described below.

Personal data may not include data which is commonly known or available or related to any third party (ies) who may have a right to use the data.

D. Type of personal data collected

We collect data related to participants and assessments from clients. Clients may provide personal information about participants. This information may include the Participant’s name, email address, information related to their role in the organisation and other contact details.

Participants, as a User, provide personal information to us via surveys or other collection methods. When participating in an assessment or otherwise using PP’s services, we will ask the User to provide information and responses, such as the following personal information:

  • “Identification Data”– The personal information collected through our website/portal may include but not limited to the User’s name, occupation, company for which the User works, business address, home address, email address and phone number, financial and credit information, and biographical information.

    You must provide Identification Data as this is required in order for us to administer the Assessment and to provide the results to the Client who requested for the assessment

 

  • “Assessment Data”-which means your responses to assessments; this may include or allow us to infer information such as:
    • motives;
    • talents;
    • skills;
    • aptitudes;
    • competencies;
    • mental toughness;
    • emotional intelligence;
    • interests; and
    • behaviour in the workplace.

Most responses within the assessments are mandatory to enable a comprehensive assessment.  We will indicate to you if a response is optional. If you do not provide a response to certain questions within the Assessment, you may not be able to proceed to the next section or it may affect your assessment score.

  • “Research Data” -which means responses to questions about you and which will include information such as:
    • your gender;
    • your age;
    • your cultural background;
    • your qualifications;
    • your work experience; and
    • details regarding your employment, responsibilities and work.

Your provision of this information is entirely voluntary. Research Data may include personal information that reveals information about you such as your racial or ethnic origin which is considered “special categories of personal information” under EEA, UK and other data protection laws (“Sensitive Data“). This Research Data does not form part of the Assessment and is only used for our as well as associate’s research purposes, including to monitor our tests and questionnaires for fairness and to maintain high standards for our Assessments.

Where required by applicable laws, if we directly request your Sensitive Data, we will ask for your explicit consent prior to collecting and processing such data. You do not have to provide Sensitive Data to us (other than images or videos, see below); however, we should be grateful if you would complete all the questions as this will help us to monitor our tests and questionnaires for fairness and maintain high standards for our Assessments. Your ability to complete an Assessment will not be affected by your choice not to provide Sensitive Data, nor will this choice affect your Assessment results.

We may ask you to enable your camera to capture images or videos of you for identification purposes for some of our assessments or when we conduct assessments for our clients. These images or videos may be provided to clients. In the event we request that you enable your camera during your participation in an assessment, this will be required for you to proceed.

From time to time, Participants may volunteer additional personal information about themselves to us, which may include Sensitive Data. For example, Participants may inform us about a health issue or disability which may impact the way in which they undertake the Assessment.

  • Performance information: information related to the job performance.
  • Website usage information: When the User uses the website/portal of PP or that of PP’s associates, we also automatically collect the following information through the use of cookies and similar technologies:
    • technical information, including your login information, browser type and version, time-zone setting, browser plug-in types and versions, operating system and platform;
    • traffic data, location data, weblogs and other communication data and data required for our own billing and administration purposes;
    • usage data, such as the source address that the page request is coming from, including the User’s Internet protocol address (IP address), domain name, date and time of the page request, the referring website (if any) and other parameters in the URL (e.g. search criteria); and
    • information about the User’s visit, including: the full Uniform Resource Locators (URL) clickstream to, through and from our Website (including date and time); pages the User viewed or searched for; page response times; download errors; length of visits to certain pages; page interaction information (such as scrolling, clicks, and mouse-overs); methods used to browse away from the page; and any phone number used to call our customer service number.
  • Correspondence: We further maintain a record of the correspondence between each User with PP.

E. Use of data from other Sources

  • Information we receive from other sources. 

This is information that PP receives about the User from other websites we operate, Information that we receive from third parties, such as business partners, sub-contractors in technical services, advertising networks, analytics providers, search information, and third party professional and social media platforms.

It is PP’s process and protocol that any personally identifiable data gathered on these platforms is in response to Users interacting out of their own volition and made available on public domain.

The client may request PP to extract the User’s information from the electronic storage system of the client. This information may include the client’s respective scoring or grading of the User which may be taken into consideration in the assessment of the User.

  • Analytics

PP’s and PP’s associates website use Google Analytics and similar technologies to collect information about how visitors use our website.

We use our own mechanism known as OZ Analytics to monitor the use of our website/portal and the processing of data in our website/portal.

  • Third Party References

As part of our Assessment process, we may request or the User may volunteer contact details of a third party; for example, someone who can answer questions about the User’s work in order to generate a 360 feedback report. The User should inform such third party that the User intend to disclose this information and obtain their prior consent to giving us their contact details.

If we have contacted you as a result of your details being disclosed to us by a User in our Assessment process, we will use that information and any subsequent information you may submit to us in accordance with this Privacy Policy.

 PP’s and PP’s associates’ websites may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates or other sites not controlled by PP. PP assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies.  Please check these policies before you submit any personal data to these websites.

 

F. Where we store your personal data

All information that you provide to us is stored on our selected business partners’ secure servers. Currently our data storage is maintained at AWS, Singapore. We will take reasonable steps to protect your information in accordance with this policy, including (without limitation):

  • Installing a secure firewall;
  • Using anti-virus protection software;
  • Encrypting data; and
  • Carrying out regular back-ups.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of any data transmitted to the Site; and any such transmission is at your own risk.  Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

G. Processing, use and disclosure of the User’s personal data

To facilitate the Assessment process, information about the User may be passed to external associates of PP from time to time who may include:

  • companies associated with PP to provide assessment of Users;
  • providers of systems to facilitate the service such as email services and enquiry response services;
  • providers of cloud-based services;
  • providers of human resource and other assessment services;
  • web-based accounting systems;
  • professional advisors and auditors;
  • third parties involved with events that you register for, to facilitate your participation in those events; and
  • disclosure of your personal information under applicable law or regulation, which may include laws outside your country of residence.

Where we use external service providers, we request those providers to implement and apply appropriate security safeguards to ensure the privacy and security of your personal information. These third parties have agreed to confidentiality restrictions and to use any personal information we share with them or which they collect on our behalf solely for the purpose of providing the contracted service to us. If personal data is transferred to any third country, we will ensure that your personal data is protected and that the transfer is carried out in accordance with applicable law.

PP and PP’s associates use the User’s personal data to be able to conduct our business in the best and most appropriate way. We use and process your personal data for the following purposes:

  • Assess the User’s Assessment and responses,
  • Assess the User’s aptitudes and preferred working styles and suitability for roles with the company the User is employed or applying for.
  • Provide the client with reports of the abilities and the ability estimation of the User.
  • Evaluate the effectiveness and efficiency of the hiring process and procedures within the company the User currently is or are applying for.
  • Maintain the integrity, increase accuracy and safety of our assessment processes.
  • To provide the Client with user-support with regard to PP’ services.
  • Anonymize the User’s personal data for product development to analyse candidate behaviour.
  • Perform data analysis for product development and product testing.
  • Enable internal research and create statistical models of estimation of abilities and suitability for different roles.
  • Enable external research, for example through universities or other organizations.
  • Fulfilment and compliance with applicable laws and regulations.
  • Protect PP from legal claims and utilize PP’s legal rights

If you choose to register a User account with us, we will also process your personal data for these additional purposes:

  • Administration and provision of the User’s-account.
  • Keep the User’s ability estimation for potential future use in other hiring processes.
  • Conduct user satisfaction surveys about our services.
  • Update database for the use of benchmarking exercise

We do not use your personal data for any other incompatible purpose.

PP may also process such personal information for research purposes. We research responses to our Assessments in the light of areas such as gender, age and cultural background over the longer term; this is considered best practice and allows PP to monitor our Assessments for fairness in use.

PP may also process your personal information for the purposes of using and refining Assessment tools, analysis, accounting, billing and audit, security, administration, enforcing and defending legal rights, systems testing, maintenance and product development, customer relations, performing our obligations to Users and clients whether under contract or otherwise, and to help us in future dealings with the User.

Personal information provided by you in relation to each of your visits to our Website will be used:

  • to administer our Website and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
  • to better understand Website usage, including which areas of our Website users prefer;
  • to improve our Website, to ensure that content is presented in the most effective manner for you and for your computer, and to develop new products and Services; and
  • as part of our efforts to keep our Website safe and secure.

PP and PP’s associates will share your personal data with your employer and/or the company you are applying for, whichever is applicable.

We may also in certain cases be required to share your personal data with public authorities or other third parties in connection with audits, court proceedings or similar reasons.

Information about Users/Participants will be disclosed to the clients in the context of the provision of our Services to them in connection with the Assessment(s) undertaken. Individual responses may be disclosed to clients, and an overall Assessment report will be provided to clients, containing an overall Assessment score and additional comments about a User’s  performance.

Our Assessments are conducted, in part, on the basis of profiling, which means that we process your personal information using software that is able to process your responses to questions and provide estimates of different attributes including your personality, preferred behaviour, motivations, talents and abilities.

If you are a participant in an assessment, you should note that it is our clients that make decisions on the basis of the assessments results. If you have any questions about how assessment results will be used in their decision-making process, you should ask the client (i.e. your employer or potential employer) for further information.

If you are a client, it is your responsibility to ensure that your decision-making process, including how you interpret the Assessment results, complies with applicable laws.

Finally, we also may disclose your personal information to third parties:

  • For the purpose of a merger or acquisition. In the event that we sell any part of our business or assets of our business, in which case we may disclose your personal data as part of our assets to the prospective buyer of the business or assets. We may also disclose your personal data to a vendor of another business or assets that we are acquiring or to a joint venture or merger partner.
  • If our assets are acquired by a third party, personal information held about our clients and Users  will be one of the transferred assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction
  • We may share aggregate or anonymised information (i.e., that which does not identify and is not linked or linkable to a particular individual), with third parties for research, marketing, analytics and other purposes

PP and its associates reserve the right to design, alter, modify the various algorithm used by the technological software utilized in the assessment of the Users.

Assessment results and reports are generated automatically by technological software and uploaded directly to the client’s storage account maintained by PP. PP shall not be responsible and shall not be held liable if any such report or assessment results is copied or downloaded and/or circulated by the client or any third party to whomsoever without the written authorization of PP having first been given.

PP does not interfere, input, amend nor qualify any report or assessment results manually or independently of the technological software designed by PP’s associates to conduct the assessment.

The User consents to the generation of the report and assessment results. PP shall not be held responsible or liable for any cause, damage, embarrassment or loss of any kind that may arise from the assessment results or evaluation reports.

H. Legal Bases for Processing / Retaining Your Personal Information

PP has a legal basis to process your personal information. In most cases, the legal basis will be to comply with our legal or contractual obligations with the client.

The User is expected to meet the legitimate interests of PP and its Associates to conduct the Assessment and to deliver Assessment results to fulfil PP’s contractual obligations to the client and further to detect and prevent fraud, misuse and unauthorised access.

PP retains the User’s  personal information (including test results) for a period of  seven (7) years , after which time we may anonymise the data and use it for research purposes.

We retain clients’ information for as long as we maintain a relationship with clients, and then for a reasonable period of time that allows us to assist with any queries, requests or complaints regarding the Assessments and/or the Services, unless a longer retention period is required or permitted by law or defined in an agreement.

We may also retain personal information longer where necessary to commence or defend legal claims, and to comply with our regulatory obligations (including record retention obligations).

The User may subscribe for a personal storage account with PP wherein certain reports or assessment which may be shared with the User is uploaded into the User’s personal account and maintained by the User. PP is not responsible and shall not be liable for any leakage or circulation of any materials which are maintained by the User in the User’s personal account.  The User is responsible to maintain the confidentiality of the User’s username password associated to the Users’ account with PP. PP and PP associates shall not be liable for any unauthorized access into the User’s account which maintained by PP

PP is a Singapore based company and subject to the jurisdiction of Singapore. The laws of Singapore shall be applicable for all services provided by PP, irrespective of the location of the client or the User. The use of any services provided by PP’s Associates may be further subject to the laws and jurisdiction of that associate

I. User’s rights

The User has the right to receive information regarding which personal data we process about the User and what we do with that data. The User also has the right to a certain degree of control over the User’s personal data. Therefore, in certain cases the User has the right to receive the User’s personal data, to have inaccurate data rectified or erased and request restriction of our processing. Furthermore, under certain conditions you have the right to object to the processing of your personal data. You may contact us in the exercise of any of these rights. If you consider that we process your personal data in an unlawful manner, you are always entitled to lodge a complaint with the supervisory authority.

Before  we process any Sensitive Data about you, you have the right to withdraw your consent by contacting us in writing via email to [email protected]. However your consent cannot be withdrawn once your data is processed and our report is generated for the client. The client shall be liable to pay for the assessment once the data is processed.

The User may opt out from receiving marketing-related communications from us. Please note that if you opt out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt out.

The User may submit a request to us related to the User’s personal information by emailing us what personal information the User would like to have changed or otherwise what limitations the User would like to put on our use of the personal information. We may need to verify the User’s identity before implementing the User’s request. We will try to comply with the User’s request as soon as reasonably practicable. We may not always be able to fully address your request; for example, if it would impact the duty of confidentiality we owe to others, or if we are legally entitled to deal with the request in a different way.

The User has no right to obtain human intervention with regard to the assessment results or reports or to express the User’s point of view, or obtain an explanation of the decision reached after such assessment or to challenge the assessment results or report.

We will at the User’s request, or at our own initiative, rectify, anonymise, erase, or complement personal data that you or we discover is inaccurate, incomplete, or misleading. The User also has the right to complete the personal data with additional data if relevant information is missing.

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion. There may also be residual information that will continue to remain within our databases and other records, which cannot  be removed.

The User may withdraw the User’s consent or unsubscribe from any, some or all of the services provided by PP at any time provided an email is sent to PP and PP shall within 30 days be responsible for responding to the user’s request to exercise the User’s rights within one month from our receipt of the request. We are entitled to extend this period by two further months when necessary, taking into account the complexity of your request or if we have received a large number of requests. We will inform you of any such extension within one month of receipt of your request, together with the reasons for the delay and information about your right to lodge a complaint with a supervisory authority.

All information and communication, and all actions we carry out, is at no cost. If the action you request is manifestly unfounded or excessive, PP is entitled to charge an administrative fee for attending to the request.

The User has the right to request that PP erases the User’s personal data and PP must erase it if the personal data is no longer necessary for the purposes for which it was collected and if agreed to by the Client, However, there might be requirements under applicable law, or other compelling reasons, that prevents us from immediately erasing your personal data. In such case, we will stop using your personal data for any other reasons than to comply with the applicable law, or the relevant compelling reason.

In determining any of the User’s right to amend, erase, cease processing or to delete any personal data of the User, PP reserves the right to determine whether the legitimate interests of PP overrides the User’s privacy rights. PP will take all reasonable and possible actions to notify any recipients of your personal data as regarding any rectification, erasure or restrictions carried out by us. At your request, we will also inform you of which third parties we have shared your personal data with.
